Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of TrustGate's identity verification services ("Services") provided through bytrustgate.com. This AUP is incorporated into and forms part of the TrustGate Terms of Service. Capitalized terms not defined herein have the meanings given in the Terms of Service.
By accessing or using the Services, you agree to comply with this AUP.
1. Permitted Uses
You may use TrustGate Services for the following lawful purposes:
1.1 Identity Verification
- Verifying the identity of individuals for customer onboarding
- Confirming that identity documents are authentic and unaltered
- Matching individuals to their identity documents through biometric comparison
1.2 Regulatory Compliance
- Anti-Money Laundering (AML) compliance obligations
- Counter-Terrorist Financing (CFT) screening requirements
- Know Your Customer (KYC) due diligence procedures
- Customer Due Diligence (CDD) and Enhanced Due Diligence (EDD)
1.3 Fraud Prevention
- Detecting and preventing identity fraud
- Identifying synthetic identities or fraudulent documents
- Preventing account takeover and unauthorized access
1.4 Other Lawful Purposes
- Age verification for age-restricted products or services
- Employment verification (subject to applicable laws)
- Any other lawful purpose disclosed to the individual being verified
2. Prohibited Uses
You may NOT use TrustGate Services for any of the following:
2.1 Illegal Activities
- Any activity that violates applicable local, state, national, or international law
- Money laundering, terrorist financing, or sanctions evasion
- Facilitating illegal transactions or criminal enterprises
2.2 Discrimination
- Discriminating against individuals based on race, color, religion, national origin, sex, sexual orientation, gender identity, age, disability, genetic information, or any other protected characteristic
- Using verification results to deny services based on protected characteristics rather than legitimate risk factors
- Building profiles or scoring systems designed to discriminate against protected classes
2.3 Harassment and Abuse
- Harassing, threatening, or intimidating individuals being verified
- Using verification data to stalk, surveil, or monitor individuals without lawful authority
- Sharing verification data with third parties for purposes of harassment
2.4 Verification Circumvention
- Submitting fraudulent, altered, or counterfeit identity documents
- Using spoofing technology, emulators, or synthetic media (deepfakes) to defeat liveness detection
- Attempting to create multiple accounts using different identities
- Coaching or assisting others in circumventing verification controls
2.5 Unauthorized Commercial Use
- Reselling, sublicensing, or redistributing TrustGate Services without express written permission
- Using the Services on behalf of third parties not disclosed in your account registration
- White-labeling or rebranding the Services as your own without authorization
2.6 Technical Abuse
- Exceeding rate limits or API usage quotas
- Attempting to reverse engineer, decompile, or extract source code from the Services
- Probing, scanning, or testing the vulnerability of our systems without authorization
- Interfering with or disrupting the integrity or performance of the Services
- Circumventing authentication, access controls, or security measures
2.7 Data Misuse
- Storing verification data beyond the retention periods specified in your agreement or required by law
- Using verification data for purposes not disclosed to the individual being verified
- Selling or monetizing verification data or biometric information
- Combining verification data with other datasets for unauthorized profiling
2.8 Consumer Reporting
TrustGate is not a consumer reporting agency under the Fair Credit Reporting Act (FCRA). You may NOT use the Services:
- As a factor in establishing consumer eligibility for credit, insurance, or employment
- As the sole basis for any decision that has legal or similarly significant effects on individuals
- As a "consumer report" under FCRA or equivalent laws
3. Customer Obligations
3.1 End-User Consent
You must obtain legally valid consent from each individual before submitting their information to TrustGate, including:
- Clear disclosure that identity verification will be performed
- The purpose for which verification is being conducted
- Information about biometric data collection (if applicable)
- Identity of parties who will receive verification results
- State-specific disclosures (e.g., Illinois BIPA, Texas CUBI) where required
3.2 Accurate Information
You must:
- Provide accurate information about your business and intended use of the Services
- Not misrepresent the purpose of verification to individuals being verified
- Notify TrustGate promptly if your use case changes materially
3.3 Data Security
You must implement and maintain appropriate technical and organizational measures to:
- Protect verification data received from TrustGate
- Prevent unauthorized access, disclosure, or use
- Encrypt data in transit and at rest
- Restrict access to authorized personnel only
3.4 Legal Compliance
You are responsible for:
- Complying with all laws applicable to your use of the Services
- Determining the lawfulness of your specific use case
- Maintaining records as required by applicable regulations
- Responding to data subject requests concerning data you control
3.5 Security Incident Reporting
You must notify TrustGate within 48 hours if you become aware of:
- Any unauthorized access to verification data
- A data breach affecting individuals verified through our Services
- Suspected misuse of your API credentials
- Any legal process seeking access to verification data

4. Enforcement
4.1 Monitoring and Investigation
TrustGate reserves the right to:
- Monitor usage patterns for compliance with this AUP
- Investigate suspected violations
- Request information about your use of the Services
- Audit your compliance with reasonable notice
4.2 Suspension
If we reasonably believe you have violated this AUP, we may immediately:
- Suspend your access to the Services
- Disable API credentials
- Restrict specific features or functionality
We will provide notice of suspension and the reason therefor as soon as reasonably practicable, unless prohibited by law or doing so would compromise an investigation.
4.3 Termination
Material or repeated violations of this AUP constitute grounds for termination of your account and the Terms of Service. TrustGate may terminate your access:
- Immediately for serious violations (e.g., illegal use, circumvention attempts)
- After 30 days' notice and opportunity to cure for other violations
4.4 No Liability for Enforcement
TrustGate shall not be liable to you or any third party for:
- Suspension or termination due to AUP violations
- Actions taken in good faith to investigate suspected violations
- Disclosure of information to law enforcement or regulators as required by law
4.5 Preservation of Rights
Taking enforcement action (or choosing not to) does not waive our right to take other enforcement actions for the same or other violations.
5. Reporting Violations
5.1 How to Report
If you become aware of any violation of this AUP, please report it to:

5.2 What to Include
Please provide:
- Description of the suspected violation
- Identity of the violating party (if known)
- Evidence supporting your report
- Your contact information for follow-up
5.3 Our Response
We will:
- Acknowledge receipt of your report within 2 business days
- Investigate the matter promptly
- Take appropriate action based on our findings
- Notify you of the outcome where appropriate and permitted by law
6. Changes to This Policy
TrustGate reserves the right to modify this AUP at any time. We will:
- Post the updated policy on our website
- Update the "Last Updated" date
- Notify customers of material changes via email at least 30 days before they take effect
Continued use of the Services after changes take effect constitutes acceptance of the modified AUP.
